4th of July Checkpoint... Charlie


Just a few notes I made watching this vid:

In some states, if you are traveling in a motor vehicle and you have signed a Driver License contract with the state, you are required to show that license on demand, with or without probable cause. In other words, they can in fact demand your ID at a checkpoint. I believe NY is one of those states.

Notice how the deputy asks, "are you a lawyer or something?" It wasn't a wise-ass remark. If he had identified himself as an attorney, that makes him an officer of the court and thereby enjoys certain legal privileges. (Doesn't matter if he is a defense attorney or a prosecutor.)

A K-9 alert is indeed probable cause to search a vehicle, despite the fact that dogs are only about 40% accurate, according to some studies. This "probable cause" is also despite the fact that many K9's are not certified, or their training certs have expired. And of course, a handler can simply train his dog to alert on subtle cues rather than a detection of contraband, drastically lowering the accuracy percentage even further. Land of the Free?

Today we celebrate our nation's birthday. Hot dogs, apple pie, but where's the freedom?


As you enjoy the holiday, take a moment to consider the reality of how far we have deviated from what was envisioned by the nation's Founding Fathers. Realize that this so-called land of the free is actually the most oppressive country in the world, literally. From international militant imperialism, to how our government treats its own people.

1 out of 100 American adults are in prison.

The United States has more people living in prison than than any other country on the planet.

One out of four people on Earth who are incarcerated live in an American penitentiary. This does not include the millions of Americans on probation, parole, or other supervised conditional release.

The U.S. incarceration rate per-capita far exceeds any other country including Iraq, Iran, Russia, or even Communist China.

China has roughly 4 times as many people as the U.S. but nearly a million fewer prisoners. Although China comes in second place for total prisoners, their per-capita rate is actually far lower then most countries and doesn't even hold a candle to the U.S. per-capita incarceration rate.

In 2013, the U.S. was in fifth place for the number of prisoners executed. China did execute more people, but not nearly enough to account for such a drastically smaller prison population both in raw numbers and per-capita.

The U.S. is the only country in the Western hemisphere who executes prisoners.

The number of Americans killed by police since 9/11 now exceeds the number of troops killed in the Iraq war.

The U.S. prisoner population has more than quadrupled since 1980.

The single largest driver in the increase in the federal prison population since 1998 is longer sentences for drug offenders.

The average inmate in minimum-security federal prison costs $21,000 each year. The average inmate in maximum-security federal prisons costs $33,000 each year. Federal prison costs are expected to rise to 30 percent of the Department of Justice's budget by 2020.

The most serious charge against 51 percent of Federal inmates is a drug offense. Only four percent are in for robbery and only one percent are in for homicide.

So can we really celebrate freedom today when there are so many Americans imprisoned, often for non-violent petty offenses? Can we really celebrate freedom when Everything is Illegal?

ATF Raids Armory to Seize Private Customer Info (VIDEO)



"This isn't just a second amendment issue, it's not just a firearms issue. It's an issue of an overreaching government that wants to come into your kitchen, that wants to come into your living room, and just see what you're doing," says Dimitrios Karras, CEO of Ares Armor in Oceanside, Calif.

Last week, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) raided Ares Armor to confiscate 80 percent polymer receivers for AR-15s. These receivers are the lower part of the gun that contain the trigger operations when fully completed. The polymer version that the ATF is contesting is not completed and requires the purchasers to finish machining it. The ATF claimed that these are unlicensed firearms, but Karras says otherwise.

"It's an object that's in the shape of a receiver, but it hasn't been completed to a point that it would be considered a firearm," says Karras. "This was a nice way for them to get their arm inside of the business and grab the information that they are actually looking for. To think that this is over a piece of plastic is ludicrous."

Karras says the true reason for the ATF's piqued interest in his shop was his refusal to relinquish the list of customers who had purchased the polymer product. He sat down with Reason TV's Tracy Oppenheimer to discuss why he plans to continue fighting the ATF to maintain his customers' privacy and other Constitutional issues at stake.

"They have trampled on the entire Bill of Rights," Karras says.

Pre-Crime 'Minority Report' Computer Program Goes Live In Chicago

University professors have teamed up with the Chicago police department to develop a new technology which will allegedly predict violent criminal behavior. Using a computerized algorithm, Chicago has now generated a "Heat List" which indexes approximately 400 individuals they see as likely to commit violent crimes in the future. And some of the people on the list are not criminals at all.

So much for the tenet of "Innocent until Proven Guilty" or even the oft repeated police-apologist sentiment, "If you don't do anything wrong, have nothing to worry about."

For 22-year old Robert McDaniel, there certainly was something to worry about, when a police commander showed up at his house simply to issue a threat that he was being watched by police. McDaniel's grew up in a gritty neighborhood, but was guilty of no crime, and had no recent interactions with police of any kind. Yet there with this official authority standing there on his porch, issuing a stern warning that since he was being watched, there would be severe consequences if he committed a crime.

Stalking, verbal threats, is this what our modern police forces have been reduced to? Forget about the very tenets of due process for a moment, and consider that the actions of the police themselves border on criminality, in this instance, and all too often actually cross the line in countless others.

You certainly don't want the police showing up at your door for no reason or otherwise to specifically threaten you, especially when you consider cases like this one, where a woman called police for help after she was assaulted and wound up suffering this terrible ordeal.

Perhaps, but that reason has nothing to do with being guilty of a crime. Where does this slippery slope end? DNA blood-draw checkpoints on every roadway? Cameras in your bedroom to ensure you aren't having deviant sex? Sound far-fetched? If you had told me, in the year 2000, the the government would be strip-searching children at airports I would have said you were nuts.

Custom Notifications in Chicago - Pilot Program
D13-09

I. Purpose

This directive announces the Chicago Police Department's pilot program for custom notification under the Violence Reduction Initiative in partnership with John Jay College of Criminal Justice Community Team, which will serve as outreach partners within the social service and community partners assembly.

II. Scope

The pilot program is effective 07 July 2013 and will continue until further notice in the 015 District.

III. General Information

A. While the Violence Reduction Strategy (VRS) is predicated upon group accountability, individuals within certain groups are identified as having the increased likelihood of victimization or engagement in criminal activity. The custom notification will identify those at-risk individuals and reach out to advise them of the risks and consequences of their actions should they engage in criminal conduct. The goal is to ensure the individual is not only informed of the law enforcement consequences for deciding to engage or continue in gun violence, but also of the devastating impact of gun violence within their community. Opportunities for seeking assistance will also be provided during the custom notification. However, it is ultimately the decision of the individual to choose not to engage in criminal activity.

B. For the identified individuals, custom notifications serve as notice that law enforcement action will not be random, but rather targeted and specific to the individual, and the failure to follow the clear and consistent message to cease participating in gun violence will have specific and cognizable penalties, as contained within the custom notification.

IV. Definitions

A. "Custom Notification" is a process that identifies potential criminal actors and victims associated with the continuum of violence. Once identified, the individual is notified of the consequences that will result should violent activity continue. The Custom Notification is predicated upon national research that concluded certain actions and associations within an individual’s environment are a precursor to certain outcomes should the individual decide to or continue to engage in criminal behavior. The Custom Notification will include a description of both federal and state sentencing options where applicable, as well as identification of the potential for seized assets and other consequences as appropriate.

1. Initial custom notifications may be predicated upon the Heat List generated by the Crime Prevention and Information Center (CPIC).

2. Ongoing custom notifications may be linked to public violence incidents (hot spots) or associated with call-ins as necessary and as approved by the district commander.

B. The "Heat List" is a rank-order list of potential victims and subjects with the greatest propensity for violence. The list is generated based on empirical data compared with known associates of the identified person.

C. "Influentials" are those individual seen as having importance or the ability to influence an individual’s actions. These can be both positive and negative influences.

D. The Custom Notification Letter will be used to inform individuals of the arrest, prosecution, and sentencing consequences they may face if they choose to or continue to engage in public violence. The letter will be specific to the identified individual and incorporate those factors known about the individual inclusive of prior arrests, impact of known associates, and potential sentencing outcomes for future criminal acts.

1. The Bureau of Organizational Development will work with the Office of Legal Affairs to develop a letter template for the Custom Notification.

2. The Office of Legal Affairs will provide review and approval of the Custom Notification Letter prior to distribution. The purpose is to confirm the range of outcomes identified as it applies to potential prosecution and sentencing outcomes.

3. The letters will be signed by the district commanders.

V. Procedures

A. District intelligence officers will:

1. continually review and update information relative to individuals linked to gun violence. These reviews will include, but are not limited to:

a. review of the Heat List for the district including the identification of those individuals who live within district.

b. CPIC information relative to criminal activity and conflicts within the district.

c. the District Gang Audit and other database information.

d. intelligence information relayed from district officers, area-assigned officers, and officers assigned to the Bureau of Organized Crime and Bureau of Detectives.

e. review of those individuals who have attended previous call-ins within the district.

2. identify those individuals eligible for custom notifications. Factors for eligibility include, but are not limited to:

a. placement on the Heat List;

b. victim of a shooting incident, where prosecution has been declined for lack of cooperation;

c. identification as a repeat offender for public violence crimes; and

d. other factors as developed and linked to public violence within the district.

3. when an individual is identified and:

a. residency is established, inform the district commander who will ensure the Custom Notification procedure is initiated.

b. residency cannot be verified, forward such information to CPIC and record the information in the district Heat List database pending subsequent confirmation of a new address. Residency will be verified and notification will occur at a future date.

B. The Custom Notification will be conducted under the direction of the district commander.

1. Those present for notifications may vary, based upon identified criminal factors, identified influentials, and other factors as identified in the review process.

2. A CPD officer will always be present for a custom notification.

C. The Custom Notification Team will:

1. generally conduct the notification at the identified individual's residence;

2. explain the Custom Notification program and the contents of the Custom Notification Letter;

3. deliver the letter to the identified individual.

NOTE:
When an identified individual is not present at the time of the custom notification, or refuses to participate, the Custom Notification Team may deliver the letter and explain the program to a family member or leave the letter at the residence.

D. When a recipient of the custom notification engages in criminal activity for which he or she is arrested, then the district commander will ensure:

1. notification to and coordination with the appropriate Bureau of Detectives Area to ensure appropriate charging occurs. The highest possible charges will be pursued for any individual in the VRS Custom Notification Program.

2. Court advocacy volunteers are notified of the date, time, and place of the bond hearing or other court hearings and encourage attendance at the hearing to demonstrate the community’s support in decreasing the violence.

3. coordination with the Cook County State's Attorney Community Prosecutions Unit as appropriate.
E. A copy of the custom notification will be forward to the CPIC and maintained within the district.

Brokeback Traffic Stop as Man Gets Rectal Reaming Over How He Stood

After shopping at a Wal-Mart store, David Eckert failed to make a complete stop at a stop-sign before he pulled into traffic to leave the plaza. He was stopped by police for the infraction.

The officer asked Eckert to step out of the vehicle. At that point, law-enforcement claim they observed that Eckert appeared to be "clenching his buttocks" and that such an observation was grounds for a search for drugs. They also claim then that a drug-sniffing K-9 alerted to the scent of drugs on the car seat. This all became grounds for a judge to sign a warrant, ordering a search of the man's anal cavity.

Police brought their suspect to a medical facility where doctors refused to perform the task, on ethical grounds.

Police then brought their suspect to another facility, in another county, where the search warrant was not valid. That medical facility proceeded with the anal-probing however, over the continued objections of Mr. Eckert.

This is how they performed the search, according to KOB Eyewitness News 4 :

1. Eckert's abdominal area was x-rayed; no narcotics were found.

2. Doctors then performed an exam of Eckert's anus with their fingers; no narcotics were found.

3. Doctors performed a second exam of Eckert's anus with their fingers; no narcotics were found.

4. Doctors penetrated Eckert's anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

5. Doctors penetrated Eckert's anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

6. Doctors penetrated Eckert's anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

7. Doctors then x-rayed Eckert again; no narcotics were found.

8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert's anus, rectum, colon, and large intestines. No narcotics were found.

The Chief of police would not comment on the case, and referred reporters to an attorney. When asked what assurances he could give that people would not be abused or violated by his police officers, the Chief replied simply:

"We follow the law in every aspect and we follow policies and protocols that we have in place." -Chief Brandon Gigante

When reporters tried to get a statement from the medical center that performed the procedures, they did not bother to defend their actions, but simply replied "no comment."

They did however, send Mr. Eckert a bill, and are now threatening to sue him if he does not pay it.

"If the officers in Hidalgo County and the City of Deming are seeking warrants for anal cavity searches based on how they're standing and the warrant allows doctors at the Gila Hospital of Horrors to go in and do enemas and colonoscopies without consent, then anyone can be seized and that's why the public needs to know about this." -Shannon Kennedy, Attorney

DALLAS — A Dallas police officer who shot a mentally ill man in a disputed incident caught on tape has been fired and charged with felony aggravated assault, police said Thursday.

Police Chief David Brown apologized for the actions of the officer, who had been on administrative leave following the Oct. 14 shooting.

Historic Sell-off Highlights Peril of Trusting Banking Cartel

What we see happening now in Europe is an example of history repeating itself, and highlights the perils for a  nation who makes a deal with the devil so to speak. In this case, the devil being the vampires of the international banking cartel.

In 1913, the United States made such a bargain, allowing the privately owned and newly formed Federal Reserve Bank to take control of our economy. At the time, it was sold to the American people as a way to stabilize our economy and to prevent all future woes. Of course, the bank was not about to fund the Federal government without some collateral.

Enter, the 16th Amendment which mandated a compulsory individual income tax, in direct violation of Article I, Section 2, Clause 3. What this meant was that the United States government now held control, through taxation, of all the fruits of the labors of its people from that point forward, and could thereby promise such as collateral to the Federal Reserve. By 1933, the Federal government was bankrupt, by design of the Federal Reserve bank of course. What happens when you go bankrupt? That's right, the bank takes ownership of your collateral. It's the same common scam used by mafia loansharks to take control of your car, your business, whole neighborhoods even while leaving you still making payments long after the initial debt was satisfied. Usury. In this case though we are talking about the entire national economy, your very identity as numbered through Social Security, along with all of the nation's gold was handed over by FDR in 1933 to keep the economy operating. That's the painfully short version anyway. That is the basis of how our economy has operated ever since. Perpetual and compounding debt, and every citizen a slave in the literal sense of the word.

This is what we are seeing happen right now in Europe. The economic turmoil in Greece, the banking crisis in Spain, even the failed attempt for the Euro to take over in Iceland. It all goes back to the consolidation of banking interests with nation-states willingly stripping themselves of sovereignty in order to participate in the Euro system. The banks reap the rewards, while the members are left saddled with debt.

Which bring us now to today's little example. Italy is now liquidating historic properties to private investors in order to keep their economy afloat and to keep the wolves from the door. In a sense, this is how Americans have recently come to find themselves locked out of public parks such as the Grand Canyon and Mt. Rushmore. Those parks really are not public at all. They are owned by the corporation called the UNITED STATES.

NFL Bans Guns for Off-Duty Cops

As if the National Football League’s regulations couldn’t get any more draconian, one NFL stadium is moving to impose even tighter gun restrictions – and this time they’re targeting the supposed good guys.

According to Cleveland.com, a memo went out to Cleveland police stating FirstEnergy Stadium, home of the Cleveland Browns, would begin outlawing firearms for off-duty cops, essentially lowering officers to the same level as the other disarmed peasants.

“Off-duty officers who attempt to bring firearms into an NFL facility will be denied entry. An armed officer will only be allowed inside a league facility if they are working an NFL game or event in an official capacity, according to the memo,” reports Brandon Blackwell.

The president of the Cleveland Police Patrolmen’s Association, Jeff Folmer, says the NFL’s decision is “disappointing.”

Personally, I applaud the move. I see no reason why law-enforcement should be extended special privileges of any sort, particularly more so when they are off duty. As CopBlock.org often says, "Badges don't grant extra rights."

While that premise may not be entirely accurate, the spirit of such a statement should be something that we hold dear as freedom-loving Americans. It is true, that police do have certain powers, namely immunity from prosecution for arrests that don't result in convictions, but short of that we should be quick to scrutinize any special powers or courtesy granted by anyone. Whether is be a free cup of coffee at the gas station, or the right to bring a dangerous weapon in to an arena full of people.

Now don't get me wrong here. I am no leftist anti-gunner. Far from it. I think that everyone should be allowed to bring their gun wherever they go, with so few exceptions that off the top of my hand I can't name one. On the other hand, if a private company sees fit to bar firearms from their property, I see it as their right to do so even I don't agree with their choice. What I cannot abide though, is hypocrisy. So in that tearing down of the double-standard, I do applaude the NFL's choice here.

After all, there really is nothing from preventing a police officer from committing a crime with his gun. Whether he be on or off duty really. We have seen so many crimes committed by police on a daily basis. Often against suspects, for whom the general public often has little concern for, but also against even their own families as well. Assault, rape, murder, these are not the exclusive purview of the common criminal but often perpetrated by those who are sworn to protect.

Obamacare and the Police State

So as the government shutdown continues more and more memes are popping up about it. Figured maybe I would put in my two-cents on the matter finally.

First, let me say I do not support Obamacare. Not because it is socialist, but because it is fascist. This isn't about nationalizing healthcare, it is about mandating our participation in capitalism. Requiring us to purchase a product from a private company. Though I am no Lefty, I have to admit that at this point, I would sooner accept government hospitals and doctors, than a mandate to participate in a system that has royally screwed us without vaseline for the past two decades with insane cost increases.


Why is a so-called "Leftist" President and a Democrat, forcing us to participate in what amounts to highway robbery by layers, pharmaceutical companies, and most of all those damned insurance companies? A program that was originally implemented in Massachusetts by Obama's last Presidential opponent, the Republican, Mitt Romney. Now more than ever it should be clear to the American people that political ideals mean nothing in the face of The Agenda being visited on us by globalists and banker scum.


At the same time though, I want to talk about another facet of this evil, the now ubiquitous police state. Like in Fascist Italy, and even more so in Nazi Germany, these extreme right-wing measures coincided with the build up of a totalitarian police-state apparatus through which all dissent was silenced, and eventually exterminated.

Well, it really doesn't get much more obvious than the dry-run for total and utter martial law than what happened in the wake of the Boston Marathon bombing where innocent civilians were ripped from their homes in true Gestapo fashion, door to door.

Let's cut to the chase here now. This is the pic that got me riled up tonight.


So what exactly is a non-essential employee? Certainly not the police who just shot an unarmed woman at the nation's Capitol. Not the NSA watching my every keystroke as I write this piece. Not the park rangers patrolling national parks that have been closed, in order to bar civilians from public property. (As if we needed the government to take a walk in the woods in the first place.)

Now this got me to thinking about the non-essential nature of even the so-called "essential" workers in the government. The non-essential nature of the police-state we live in. Everything from suspected child molesters molesting kids at airports on your dime, through the TSA, to the government extortion scheme known as the War on Drugs.


When Americans think of a police-state, they tend to think of places like Communist China. But despite the fact that they have nearly 4 times as many people as America, they actually have fewer prisoner. Not per-capita mind you, literally fewer prisoners. Per capita, we lead the world by far. We have only 5% of the total human population on the planet, yet 1 out of every 4 people in prison on Earth, live in an American prison.

So let's really cut to the chase here now, when we are talking about non-essentials. No one really wants to talk about the real cost to taxpayers to enslave ourselves, so there really aren't too many studies to go by. But there was one implemented in the state of Maryland a few years ago, that was quite enlightening. I believe this is something that should be done annually, in every state, and of course by Federal law agencies as well. But since we don't have that sort of clarity and accountability from our government. Let this serve as an example, to show you where your money is really going.

4.5 SWAT Raids Per Day

Maryland's SWAT transparency bill produces its first disturbing results







 Cheye Calvo's July 2008 encounter with a Prince George's County, Maryland, SWAT team is now pretty well-known: After intercepting a package of marijuana at a delivery service warehouse, police completed the delivery, in disguise, to the address on the package. That address belonged to Calvo, who also happened to be the mayor of the small Prince George’s town of Berwyn Heights. When Calvo's mother-in-law brought the package in from the porch, the SWAT team pounced, forcing their way into Calvo's home. By the time the raid was over, Calvo and his mother-in-law had been handcuffed for hours, police realized they'd made a mistake, and Calvo's two black Labradors lay dead on the floor from gunshot wounds.

As a result of this colossal yet not-unprecedented screw-up, plus Calvo's notoriety and persistence, last year Maryland became the first state in the country to make every one of its police departments issue a report on how often and for what purpose they use their SWAT teams. The first reports from the legislation are in, and the results are disturbing.

Over the last six months of 2009, SWAT teams were deployed 804 times in the state of Maryland, or about 4.5 times per day. In Prince George's County alone, with its 850,000 residents, a SWAT team was deployed about once per day. According to a Baltimore Sun analysis, 94 percent of the state's SWAT deployments were used to serve search or arrest warrants, leaving just 6 percent in response to the kinds of barricades, bank robberies, hostage takings, and emergency situations for which SWAT teams were originally intended.

Worse even than those dreary numbers is the fact that more than half of the county’s SWAT deployments were for misdemeanors and nonserious felonies. That means more than 100 times last year Prince George’s County brought state-sanctioned violence to confront people suspected of nonviolent crimes. And that's just one county in Maryland. These outrageous numbers should provide a long-overdue wake-up call to public officials about how far the pendulum has swung toward institutionalized police brutality against its citizenry, usually in the name of the drug war.

But that’s unlikely to happen, at least in Prince George's County. To this day, Sheriff Michael Jackson insists his officers did nothing wrong in the Calvo raid—not the killing of the dogs, not neglecting to conduct any corroborating investigation to be sure they had the correct house, not failing to notify the Berwyn Heights police chief of the raid, not the repeated and documented instances of Jackson’s deputies playing fast and loose with the truth.

Jackson, who's now running for county executive, is incapable of shame. He has tried to block Calvo's efforts to access information about the raid at every turn. Last week, Prince George's County Circuit Judge Arthur M. Ahalt ruled that Calvo's civil rights suit against the county can go forward. But Jackson has been fighting to delay the discovery process in that suit until federal authorities complete their own investigation into the raid. That would likely (and conveniently) prevent Prince George's County voters from learning any embarrassing details about the raid until after the election.

But there is some good news to report here, too. The Maryland state law, as noted, is the first of its kind in the country, and will hopefully serve as a model for other states in adding some much-needed transparency to the widespread use and abuse of SWAT teams. And some Maryland legislators want to go even further. State Sen. Anthony Muse (D-Prince George's), for example, wants to require a judge's signature before police can deploy a SWAT team. Muse has sponsored another bill that would ban the use of SWAT teams for misdemeanor offenses. The latter seems like a no-brainer, but it's already facing strong opposition from law enforcement interests. Police groups opposed the transparency bill, too.

Beyond policy changes, the Calvo raid also seems to have also sparked media and public interest in how SWAT teams are deployed in Maryland. The use of these paramilitary police units has increased dramatically over the last 30 years, by 1,000 percent or more, resulting in the drastic militarization of police. It's a trend that seems to have escaped much media and public notice, let alone informed debate about policies and oversight procedures. But since the Calvo raid in 2008, Maryland newspapers, TV news crews, activists, and bloggers have been documenting mistaken, botched, or disproportionately aggressive raids across the state.

Lawmakers tend to be wary of questioning law enforcement officials, particularly when it comes to policing tactics. They shouldn't be. If anything, the public employees who are entrusted with the power to use force, including lethal force, deserve the most scrutiny. It's unfortunate that it took a violent raid on a fellow public official for Maryland's policymakers to finally take notice of tactics that have been used on Maryland citizens for decades now. But at least these issues are finally on the table.

Lawmakers in other states should take notice. It's time to have a national discussion on the wisdom of sending phalanxes of cops dressed like soldiers into private homes in search of nonviolent and consensual crimes.

Racial Profiling or Bad Police Work?

The oppression of the modern police-state against the people is something that can't be understated, and seems to only get worse by the day here in America. From criminal cops, to incompetent cops, to flat out bad policy which the police are there to enforce,  it's little wonder that there are more and more Americans who are fed up and speaking out.

Unfortunately, there is a racial dynamic to these problems as well. There are racist people people in our society and therefore it should come as no surprise that a certain amount of that will make it into police forces. But racism and bigotry are not necessarily synonymous either. Racial profiling is not necessarily born of some inherent hatred of people with different levels of melanin. It has been argued by some that, statistically speaking, black people are more dangerous than white people. Even within the black community, a black person is far more likely to be killed by another black person.

To look at it another way, if you happen to be driving a Honda Accord, the police may "profile" you based on the car you are driving. They may give you a little closer scrutiny in a routine traffic stop, ask a few more questions, be a bit more insistent, based on the fact that the Accord is the most frequently stolen car in America. It's not the job of the police to harass Honda owners though simply because they didn't choose to buy American. Which is why a whole host of other factors should go into the formulation of deciding whether or not there is something suspicious going on.

They are probably not as likely to be so suspicious of a woman driving a Accord with two kids in the car on a Sunday afternoon, as they would be of a teenager who was stopped in the middle of the night for driving without the headlights on. It also doesn't rule out the possibility that a mother of two might be driving a stolen Ford around town on a Sunday afternoon either. So from these examples we can see that while profiling may have some basis in general context when an officer conducts an investigation, it is not applicable as the entire basis of an interaction with police. It's just bad police work to be overly focused on any particular profile, all moral considerations aside. This is one good reason why profiling should not be the basis of policy as it is now in places in places like New York City.

While the crap-storm swirls around the racial element of the deluded Mayor's policy and his comments, the core truth of the matter gets completely left out. The race-card has trumped the real flaw in the policy. That flaw is the blatant disregard for the 4th Amendment of the Constitution. The problem is not that the NYPD is stopping and frisking minorities. The problem is that they are stopping and frisking anyone without probable cause or a warrant. The problem is that there is a policy in place that would even allow people to be stopped simply on the basis of their skin color in the first place.

The debate over percentages and numbers is beside the point. If this despicable policy were not in place, then the police could not be stopping and harassing minorities or anyone else. The problem is not that minorities are being targeted by this policy, the problem is the policy itself. While white people may not be stopped as frequently, you can be sure that a white kid low-riding his pants, wearing hip-hop duds and listening to Immortal Technique is just as likely to be harassed by the NYPD. People with tattoos, people with piercings, people living in high crime areas, people driving Honda Accords may all be targeted without actual cause.

Of course, this is not just a NY thing. Black folk often feel that they are being targeted because of their race alone. Sometimes their complaint has some validity. Often times though, it doesn't. Take this case of a man who was arrested for DUI, even though he wasn't drunk.

The 64-year old black man was arrested, thrown into the back of a police vehicle and had his car impounded, even though he was not drunk at all. The officer disagreed with the breathalyzer device and decided to make the arrest anyway based on the fact that Jessie Thornton had bloodshot eyes. Keep in mind that alcohol doesn't always cause bloodshot eyes, and that it is just as illegal to drive under the influence of substances like marijuana as it is to drive drunk. Thornton admits his eyes may have looked bloodshot, but says that may have been due to a late night swim at a fitness center.

Mr. Thornton doesn't see a flaw in the law though, and he doesn't complain that the officer was just incompetent and unable to tell the difference between a DUI and a man who just climbed out of a swimming poor. Instead, he believes the officer was a racist.

“It was driving while black,” he said, adding: “I just don’t want any of this to happen to somebody else.”

Was the officer really a racist though? Was he really profiling the driver? It's possible, but there is no real reason to believe that based on the information which Mr. Thornton himself shared with the media in that article. So outside of that, either the officer was utterly incompetent, or he was just a cop harassing a citizen. A bully, which is more often than not the fact of the matter. Those same two options stand in this following case, where a white woman was arrested for being drunk, when she was actually the designated driver and had not touched a drop of alcohol that night.

In short, police are not the spokespersons for "white people" and are not a standing army to protect whites from blacks. It's time we take a step back from the racial issues and take a good hard look at what is happening to our country. All of us, black, white, and all the rest across the board are being targeted by a fascist police-state. We are not so different at all really, we the people that is, and we have a common enemy. Tyranny.
